无论是对职业经理人还是企业家,解雇员工都是一个痛苦的过程,而如今硅谷的很多公司负责人都在经历这个过程。随着美国经济的日益衰退,硅谷也难以自保。红衫的56页slides,标点和著名天使投资人Ron Conway给自己参股公司的信都明确的建议公司CEO们要缩减开支,准备“过冬”。有了的前车之鉴,明智的CEO们都听取了建议,适度的裁掉了部分员工。Mahalo的CEO Jason Calacanis真诚而详尽的总结了自己的裁员过程。我总结一下他的观点希望能对朋友们有帮助。

尽可能在一轮中裁掉想裁的人:如果是多轮来裁人,很容易在公司内造成恐慌的氛围,
不要一个一个的裁人:很多人处于人性化的考虑,可能会觉得一对一的交流会更好些。但事实很可能是等在座位上的员工焦虑的互相交流,等待自己的谈话的来临。最好是把所有员工(包括留下的员工)集合在一起,告诉他们你要对公司做出人员上的调整,然后请那些留下的人离开。
不要拐弯抹角:你需要100%真诚的面对即将离开的员工告诉他们为什么你要裁员,为什么要裁掉他们,和为什么会留下其他的人。给大家足够长的时间来交流。
普遍的降薪通常不是一个好办法:普遍的降薪会让所有人都不开心。尤其是那些出色的员工很可能会开始找其他的工作了。而那些留下的人也很可能是能力不强,找不到其他工作的人。这样只会让公司变得更加低效。
做的越大度越好:即使并不需要,也要给足够的解雇费。让离开的员工兑现尽可能多的股票。尽量提供他们其他的工作机会。如果你觉得有朝一日你会有新的工作机会,提供给这些你认为值得的解雇员工。
时间:最好是在快下班的时候来做。如果被解雇的人没有其他问题了,就让他们离开。没有必要拖延时间。
让留下来的员工尽快进入到工作状态中:要让留下来的人明白接下来公司的目标是什么。人们的震惊和疑虑是难免的。但要让他们明白这些都是为了公司能更好的前进和完成自己的使命。

篇6:如何“完美”解雇员工
这绝不是叫员工走人的方式
27岁那年,格雷格·苏德兰斯被解雇了。刚从大学毕业,他就在芝加哥附近一家卖酒的公司当销售助理。苏德兰斯开着那辆现代“奏鸣曲”汽车整日奔波于74号州际公路,把一箱箱酒卖给酒店,每周工作35个小时,领着约4万美元的年薪。但不管工作多么拼命,他从未完成过定额。终于,在1月的一个寒风刺骨的夜晚,上司把他叫到了后台办公室。苏德兰斯甚至还未坐下,一位上司就开始大叫大喊,责备他妨害了经营利润,还对苏德兰斯的职业道德心存怀疑,并满腹狐疑地问他对于竟然能够保持这份销售工作有何想法。然后说:“你被开除了!”

但有少数几位it经理同意贡献出时间与意见谈谈解雇,他们都介绍了一种合理、明确的方案具有的类似特性。这些高层主管发现一些行之有效的方法与对解雇员工的最佳方法的大量研究相吻合。
这种方案的第一步是找出有问题的雇员,然后通告他们没有尽职。你应该亲自与该员工面对面地交流,不要交给人力资源办公室处理。赞同这种方法的cio说,他们给处境不佳的雇员60到120天的时间改善业绩。许多公司制订有特殊计划,旨在让员工了解成败攸关时期的重要性。最近担任公司cio的普尼特·巴辛开展了一项他称之为“业绩改善计划”的方案,希望把边缘雇员从边缘拉回来。而在政府特许设立的住房补助公司freddie mac,信息系统高级副总裁比尔·莱德曼采用了具有类似用途的“差距弥补计划”。

暗示·询问·解雇
不是每项案例都得这样结束,一些it经理还摸索出了自己的一套解雇方法。在caregroup医疗系统公司,cio约翰·哈拉姆卡就采取了进步训练与他称之为“询问——告诉——询问”相结合的方法。
这种交互策略旨在使雇员比较坦然地面对自己的命运。被解雇从来不是件舒服的事,但哈拉姆卡发现这方法能保护雇员的尊严。询问——告诉——询问的方法依据这种观念:如果某人已经料到会听到坏消息,那么告诉他就比较容易。作为急诊医生、同时担任哈佛医疗学院教育技术副院长的哈拉姆卡认为,这种策略尊重了人的天性。
在caregroup,解雇通常以这一问题开始:“从对你进行察看以来你觉得你的业绩如何?”哈拉姆卡说,大多数时候,员工都知道自己的表现不尽如人意,回答时就知道自己即将被解雇。这时,哈拉姆卡再证实这种怀疑:“是的,你想的没错,你将失去工作。”话一说完,他立刻提出另一个问题:“对此你怎么看?”

心理大全
虽然哈拉姆卡的方法旨在和婉地把员工请出门外,但钱林杰却抨击这是逃避行为。钱林杰说,询问——告诉——询问的方法不合理地将责任从经理转移给了雇员,让后者宣布自己的糟糕业绩。高科技咨询公司sei采取了另一种手法,力求减轻解雇造成的心理打击。开除工作表现差的员工前,sei的高层主管会竭力说服他们辞职。人力资源主管罗德·鲍斯韦尔说,这种方法使雇员能够不失尊严地离职,因为决定命运的正是他们自己。鲍斯韦尔称为“心理大全”的这种办法没有痛苦地获得了所需结果。举例说,去年,由于一位年轻的程序设计员一再拒绝佩戴公司服装编号,鲍斯韦尔告诉这年轻人:如果不首先辞职,他将被公司开除。结果,那人当天就跳了槽。
一些公司则尽量设法避免解雇员工。conoco的cio托马斯·奈斯沃纳与其hr部门的代表一道制定了一项雇员再培训与再指派计划,以便留住那些处境如同走钢丝般岌岌可危的员工。20世纪90年代初,公司启动了这项名为hireconoco的计划,这项全公司范围内的活动目的是为了指派面临解雇危险的员工到公司其他部门担任新职位。

虽然愤世嫉俗者可能会把conoco的方法比作埋掉烂苹果而不是扔掉,但gartner的莫雷罗说,解雇员工的时候态度温和极其重要。在解雇时看似无情或高兴的it经理会有招致臭名声的危险。it人喜欢高谈阔论,坏消息会不胫而走。爱达荷电力公司的cio卡尼强调,他与从事不同职业的同一批人工作过。他说,如果解雇时不顾对方的尊严,任何一名雇员都可能在背后议论雇主的过去,从而暗中破坏其目前的工作。
卡尼指出,解雇时毫不留情留下的恶名不仅会疏远现有的雇员,还会把未来的求职者吓跑。关键在于一开始要处理好。“我所做的一切都可能会影响我的名声,”卡尼说,“但如果善待员工、怜悯而不失尊严地对待他们,你就没必要担心自己的名声。”

对inet金融服务公司的苏德兰斯来说,被最初几位上司解雇不堪回首,但这也教会了他许多道理。苏德兰斯建议:为了理解大多数人一被解雇就会产生的被人抛弃、狂怒与怀疑的心情并有所准备,经理们不妨旁听新职介绍咨询服务会议。

上诉人因不服xx市第xx人民法院(201x)东二法民一初字第38xx号民事判决书,现依据事实和法律提出上诉
上诉请求:
1、请求判决撤销xx市第xx人民法院(201x)东二法民一初字第38xx号民事判决书第二、三、四、五项;
2、请求改判xx市第xx人民法院(201x)东二法民一初字第38xx号民事判决书第二、三、四项为:
被上诉人支付上诉人一次性伤残就业补助金74000元(1850元/月×40个月=74000元),一次性工伤医疗补助金14800元(1850元/月×8个月=14800元);
被上诉人支付上诉人6月至月未足额支付工资差额2505.21元(10795.21元-8290元=2505.21元),201x年1月份工资2126元(1850元÷30天×25天=1542元,从201x年1月1日计算至201x年1月25日);
被上诉人支付上诉人未签订劳动合同二倍工资差额10808.4元(737.96元+1850元+1850元+1132.06元+2319.66元+1376.72元+1542元=10808.4元,从年7月15日计算至201x年1月25日);
被上诉人支付上诉人违法解除劳动合同赔偿金3700元(1850元/月×1个月×2=3700元);
以上总计107355.61元。
3、本案的诉讼费用由被上诉人承担。
事实与理由:
一审法院在一审过程中存在前后事实认定错误,造成其所认定的事实前后矛盾,并且适用法律错误,主要体现在其对一审中归纳的焦点的认定部分:
1、焦点一:b公司是否违法解除与a先生的劳动关系。一审法院认定a先生“在厂区内打人”及“多次打卡不上班”的事实,因此b公司解除与a先生的劳动关系“依法有据”。
关于“在厂区内打人”一事上诉人在一审中已经明确说明了双方因为工资问题,上诉人只是推了一下财务人员,而且没有造成财务人员的任何损伤,因此不存在打人的事实,加上事件发生在2010年9月份,但是b公司却在201x年1月份解雇上诉人,若b公司因这件事需要对上诉人作出处理的话也应当在9月份左右,即被上诉人所谓的“打人”事件发生以后的短期,这是一般的常识,因此被上诉人依据此条理由解雇被上诉人是不成立的。
关于“多次打卡不上班”,一审中被上诉人b公司并未向法院提交其规章制度证明“上班不打卡”是应当“解雇”的。上诉人认为即使存在上班不打卡的情况,但是b公司的规章制度也没有规定可以以此解雇上诉人,法律更是没有对此作出任何规定。因此,b公司解雇上诉人的缺乏依据,一审法院却作出“依法有理”的认定,一审法院的认定明显存在错误。
2、焦点二:b公司支付给上诉人的一次性伤残就业补助金、一次性工伤医疗补助金的金额。根据《xx省工伤保险条例》第26条的规定,计算标准是“本人工资”而非一审法院所认定的“缴费工资”,而上诉人的本人工资应当是指上诉人的月平均工资,缴费工资是b公司单方面向社保机构申报的数额,并没有得到上诉人的确认,因此一审法院认定事实及解读法律错误。
3、焦点三“b公司是否已足额支付a先生2010年8、9、10月份的工资”,一审法院适用的是《xx省工伤保险条例》第二十三条的规定,上诉人认为一审法院引用法律正确,但解读法律错误——该条法律已经明确规定“在停工留薪期内,原工资福利待遇不变”,一审法院却认定“以xx市职工最低工资标准920元/月支付a先生2010年8、9、10月份的工资,不违反法律法规的强制性规定”,一审法院明显是错误的:难道法律规定的“原工资福利待遇不变”就等同于“xx市职工最低工资标准”?难道被上诉人以最低工资标准支付工伤医疗期间的工资不是“违反法律法规的强制性规定”?一审法院认定事实及适用法律的逻辑思维存在严重的.错误。
其次,一审法院在认定焦点二的事实的时候已经错误的将“本人工资”等同于“平均月缴费工资”,既然一审法院将两者等同起来,那么在计算工伤期间的工伤福利待遇也应当按月缴费工资1200元来计算而非920元的最低工资标准计算,一审法院认定事实前后矛盾。
4、焦点四:“xx市职工最低工资标准公司支付的二倍工资差额”。同上,既然一审法院将“本人工资”等同于“平均月缴费工资”,那么在计算二倍工资差额的时候也应当采用1200元的月平均工资数额,但是一审法院却采用了反推的逻辑,并再次采用最低工资标准来计算月工资,一审法院认定事实前后矛盾。
5、在一审过程中,一审法院已经认定了“b公司支付给上诉人的加班费低于xx市职工最低工资标准,应当补足”(一审判决书第9页第8、9、10行),但是一审法院在判决书的判决结果中却没有对此作出判决。
综上,上诉人认为一审法院的判决存在严重的错误,对事实的认定及法律的适用上均存在严重的矛盾及偏差,因此请求贵院对此案进行重新审理,以查明案件的真实情况,维护上诉人的合法权益。
